Afghan Refugee Detained by ICE After Asylum Hearing in New York
A 31-year-old Afghan refugee, identified only as Ali, was detained by U.S. Immigration and Customs Enforcement (ICE) officials following a political asylum hearing at a federal court on Long Island. The incident occurred on October 14, 2023, as Ali attended a “credible fear” interview regarding his asylum application. His family and supporters express serious concerns for his safety should he be deported back to Afghanistan.
Ali has resided in the United States since February 2022, a period marked by the withdrawal of American troops and the Taliban’s return to power in Afghanistan. His family fears that his return could be life-threatening due to his previous affiliations with the former Afghan government.
According to ICE records, Ali is currently held at the Delaney Hall Detention Facility in Newark, New Jersey. An ICE spokesperson indicated that a public affairs officer would respond to inquiries about Ali’s detention, but as of the latest updates, no further communication has been received.
During the hearing, Ali, accompanied by his lawyer and family members, expressed to the judge that returning to Afghanistan would present significant risks to his life. His sister, Sayeda, recounted the day’s events, explaining that after being informed he had passed the credible fear interview, Ali was suddenly detained by ICE officers who appeared unexpectedly in the courtroom.
Sayeda described the situation as traumatic, noting that her brother was simply following legal procedures. She emphasized that Ali has no criminal record or existing deportation order. Prior to his detention, he was employed in security at a local hospital and studied full-time at Bard College, contributing to the community and paying taxes.
“We are working here. He was paying taxes. He was a full-time student,” Sayeda said. “He’s not a gang member. He’s not a criminal. Why is there no justice?” She highlighted the challenges faced by her family, asserting that the detention of her brother, the eldest son and provider for a family of eight, imposes an undue burden on them.
The family has received support from the Christ the King Episcopal Church in Stone Ridge, which has been involved with them since their resettlement. The church has hosted monthly Afghan dinners, prepared by Ali and his family, which have not only provided financial assistance but also fostered community connections. Rev. Marcella Gillis noted the strong support from the local community, stating that the dinners have become a vital source of gathering and interfaith collaboration.
In light of Ali’s detention, a dinner scheduled for October 16, 2023, was cancelled due to the emotional strain on the family, though future events are planned to continue supporting them. Gillis emphasized the importance of the community’s involvement, stating, “The whole community has rallied around (the family) in the most incredible way.”
Local officials have expressed deep concern regarding Ali’s detainment. State Senator Michelle Hinchey criticized the current administration’s approach, arguing that it contradicts the stated intentions of targeting only those who have committed violent crimes. She stated, “Ali sought asylum legally and is in the final stages of obtaining legal status. He has committed no crime, caused no harm, and is a valued member of our community.” Senator Hinchey called for unity against what she termed “cruel and unjust detainments.”
Similarly, Ulster County Executive Jen Metzger voiced her alarm over Ali’s situation, highlighting the protections traditionally afforded to asylum seekers in the United States. She described the detention as a “cruel act” and joined advocates in demanding his release and return to his family.
Gillis reiterated the impact of Ali’s detention on both his family and the wider community, emphasizing that he is well-loved and respected. His legal team is actively working on petitions to secure his release while awaiting his next court date.
The circumstances surrounding Ali’s detention have raised broader questions about the treatment of asylum seekers in the United States and the implications of current immigration policies. As the community rallies to support Ali, his family and advocates continue to seek justice and a swift resolution to this troubling situation.
