UPDATE: The Australian Communications and Media Authority (ACMA) has just reaffirmed its commitment to strict gambling regulations, rejecting claims of softened enforcement actions regarding Sportsbet. This urgent clarification follows public outcry and scrutiny over the regulator’s handling of a significant AUD 2.5 million ($1.7 million) fine imposed on the betting operator for breaching spam communication laws.

The controversy erupted after documents revealed that Sportsbet challenged the 2022 enforcement decision and allegedly pressured the ACMA to revise a public announcement about the case. The regulator is now facing accusations of not only compromising its integrity but also of yielding to external pressures from powerful industry players.

In a statement to ReadWrite, the ACMA denounced any suggestions that its enforcement actions had weakened. The authority emphasized that its compliance efforts are focused on stopping illegal conduct, deterring future violations, and protecting consumers from harm. “In our spam prevention activities alone, in 2024-25, the ACMA issued infringement notices to companies totaling more than AUD 13.5 million,” the agency reported.

This includes a hefty AUD 7.5 million ($5 million) penalty imposed on the Commonwealth Bank of Australia (CBA) for sending over 170 million non-compliant marketing emails. The CBA case has also attracted criticism, especially after revelations surfaced that senior bank officials lobbied the ACMA to delay announcing their penalty until after the bank’s annual general meeting.

Former Supreme Court judge Anthony Whealy, now chair of the Centre for Public Integrity, has condemned the decision to postpone the announcement, labeling it “quite wrong.” Shareholders have echoed these concerns, suggesting that the bank’s influence over the regulator raises serious questions about accountability.

Addressing the backlash, the ACMA clarified that any changes made to the media release regarding Sportsbet did not alter the outcome of the investigation or the enforcement action. The authority stated, “The ACMA will continue to take strong, proportionate action to ensure companies meet their legal obligations.”
