Former Appellate Justice Daniel Kremer Dies at 88 After Illness

URGENT UPDATE: Daniel Kremer, a highly esteemed former presiding justice of the San Diego-based appellate court, has passed away at the age of 88. Kremer died on February 17, 2023, in Del Mar, California, following a brief illness, as confirmed by his family.

Kremer’s death marks the end of an illustrious legal career that spanned several decades, significantly impacting the California judicial system. He is remembered for his remarkable resilience, having overcome polio as a teenager, which left him with a weakened leg but did not diminish his formidable intellect and leadership abilities.

Throughout his career, Kremer served in various pivotal roles, including the state Attorney General’s Office and the San Diego Superior Court. He was appointed to the 4th District Court of Appeal, Division 1, where he spent the last 18 years of his career before retiring in 2003. His contributions to the judiciary earned him the title of Jurist of the Year in 2002, the highest accolade awarded by the California Judicial Council.

U.S. District Judge Jeffrey Miller, who worked alongside Kremer in the 1970s, stated, “When I think of Dan, I think of excellence.” Miller praised Kremer’s patience, civility, and tireless work ethic, noting that he was a “natural leader” respected by all.

Kremer was deeply committed to the rule of law and integrity, values he instilled in his colleagues. Gary Schons, who Kremer mentored as a deputy attorney general, highlighted Kremer’s unwavering dedication to public service and legal excellence. Schons remarked, “Dan was the consummate public servant, public lawyer and judicial officer.”

During his tenure as presiding justice, Kremer was a key member of the California Judicial Council from 1991 to 1994, where he chaired several committees, including the Rules and Forms Committee and the Court Technology Committee. Notably, he led the Task Force on Court Facilities, assessing the state’s courthouses and recommending necessary upgrades.

Kremer was born on November 21, 1937, in Olympia, Washington. His battle with polio at age 13 shaped his determination and commitment to education. After earning his undergraduate and law degrees from Stanford University, Kremer’s career quickly ascended, culminating in numerous judicial appointments.

Beyond his legal achievements, Kremer was also an active community member, volunteering with the KPBS Radio Reading Service to assist the visually impaired. His family recalls his dedication to both his professional and personal life, highlighting how he balanced his career with his roles as a husband and father.

Kremer and his wife, Kathryn, were married for 56 years until her passing in 2020. They shared a passion for theater, history, and travel, often exploring Europe together after his retirement.

Kremer is survived by his two sons, Aaron and Brendan, along with their families. Services will be held on April 24 at St. James Catholic Church in Solana Beach, California. In lieu of flowers, the family requests donations to the Ashland Shakespeare Festival or KPBS.
