Alina Habba Resigns as U.S. Attorney for New Jersey After Court Ruling

Alina Habba, former personal lawyer to President Donald Trump, resigned from her position as the U.S. Attorney for New Jersey on Monday following a ruling from the 3rd U.S. Circuit Court of Appeals. The court upheld a previous decision that declared her appointment unlawful due to a lack of U.S. Senate confirmation, a breach of federal law protocols.

In a statement, Habba expressed her commitment to the office and the necessity for her resignation. “As a result of the Third Circuit’s ruling, and to protect the stability and integrity of the office which I love, I have decided to step down in my role as the U.S. Attorney for the District of New Jersey,” she stated. Despite her resignation, she emphasized her ongoing dedication to the Department of Justice, taking on the role of Senior Adviser to the Attorney General for U.S. Attorneys.

Habba was initially appointed in March 2023 for a temporary term as acting U.S. attorney. When her term expired in July, a panel of federal judges appointed one of her subordinates to the position. In a swift response to this change, Attorney General Pam Bondi dismissed the replacement, attributing Habba’s removal to “politically minded judges.”

Bondi expressed her disappointment in accepting Habba’s resignation, stating that the court’s ruling rendered it “untenable for her to effectively run her office.” She criticized the judges, arguing that they should not interfere with the President’s selection of attorneys responsible for prosecuting crime. “The Department of Justice will seek further review of this decision, and we are confident it will be reversed,” Bondi remarked on social media platform X.

The ruling against Habba is part of a broader pattern affecting several Trump administration prosecutors, who have faced similar challenges to their appointments. Recently, the Department of Justice announced plans to appeal a ruling that dismissed criminal cases against former FBI Director James Comey, as well as New York Attorney General Letitia James. This decision stemmed from concerns over the legality of Lindsey Halligan’s appointment as interim U.S. attorney for the Eastern District of Virginia.

In light of these events, Bondi and Deputy Attorney General Todd Blanche accused judges of conducting an “unconscionable campaign of bias and hostility” against Halligan, questioning her legitimacy as U.S. attorney in court documents.
