Trump’s Executive Order Reshapes Colorado’s Cannabis Landscape

President Donald Trump has issued an executive order that could significantly impact Colorado’s struggling cannabis and CBD markets. This move, aimed at rescheduling marijuana to a Schedule III classification, has generated mixed reactions within the industry, which has seen declining sales over the past five years. According to the Colorado Department of Revenue, dispensary sales have dropped steadily, and while the executive order will not resolve all existing issues, it may provide opportunities for cannabis businesses to secure better financial partnerships and navigate federal tax regulations.

One notable response to the order comes from Charlotte’s Web, a Colorado-based hemp and CBD company. The firm announced plans to launch an online CBD marketplace specifically for senior citizens. This initiative aims to provide cancer patients with access to science-backed CBD products under new Medicare and Medicaid coverage programs. The company emphasized that this development will create a model of care focused on personalization, accessibility, and affordability.

Legal experts and cannabis industry advocates see the potential benefits of a Schedule III designation. Chuck Smith, CEO of Colorado Leads, described the rescheduling as a “big step” that acknowledges the unfair tax burdens cannabis businesses have faced. Currently, cannabis companies are subject to federal tax rates as high as 70 percent under IRS regulations. Smith noted, “While rescheduling alone will not resolve all the challenges created by conflicting state and federal laws, it is an important development that is long overdue.”

Despite the optimism, the order has sparked concerns among various groups. Pam Bondi, the Attorney General, has been directed to facilitate the rulemaking process regarding the rescheduling.
