											UPDATE: A federal judge in Boston is currently deliberating on a critical ruling that could impact food assistance for millions. District Court Judge Indira Talwani is considering whether to order the Trump administration to continue Supplemental Nutrition Assistance Program (SNAP) benefits amid the ongoing government shutdown, which threatens the livelihood of approximately 42 million low-income Americans.
During a tense preliminary hearing on October 5, 2023, Judge Talwani expressed her inclination to side with New York Attorney General Letitia James and 24 other Democratic-led states who are demanding that federal officials utilize an emergency fund to maintain SNAP payments. “You are not going to make everyone drop dead because it’s a political game someplace,” Talwani asserted, emphasizing the urgency of the situation.
The USDA had announced plans to freeze SNAP payments in just two days due to funding lapses, raising concerns among those dependent on these benefits. The program serves around 1 in 8 Americans and costs about $8 billion per month. In New York alone, nearly 3 million people rely on SNAP, with 2 million in New York City’s five boroughs depending on these funds for essential groceries.
Talwani highlighted the absurdity of deeming the current crisis as anything less than an emergency, stating, “It’s hard for me to understand that this is not an emergency, when there is no money and a lot of people are needing their SNAP benefits.” She suggested that if the federal government lacks the funds to fully support the program, it should find an equitable way to partially fund SNAP payments to states.
In response, a government lawyer warned that issuing partial payments would complicate the administrative processes for states, potentially delaying benefits for weeks. “Involving complicated system changes and processes,” the lawyer stated, raises questions about how swiftly beneficiaries could access their funds.
The implications of Judge Talwani’s ruling could be significant. If she decides to order the continuation of SNAP benefits, it may provide immediate relief to millions of Americans grappling with food insecurity during this shutdown. Conversely, a ruling against the continuation could exacerbate an already dire situation for those relying on government assistance.
